Know Your Rights Before You Sign a Lease
There are a few laws that exist that are there not only to protect the tenants rights, but also the right of the apartment management company to protect the property. The tenant deserves to be treated fairly. Here are a few guidelines that will help you understand your rights when you lease an apartment community.

Housing Regulation Resources

Laws will vary state by state, so if you read about laws governing the state of Texas, these may be different than the state of Georgia. Each state will have restrictions and rules governing the security deposit. There are laws in place that will dictate how long a landlord is allowed to keep the deposit after you move out. The security deposit is one of the most litigated issues in the apartment industry today between the tenant and landlord. However, in the states of West Virginia and Tennessee, there are not guidelines that oversee the security deposit issue. There is a great site users can visit for questions regarding the security deposit. (Nolo.com). If you have questions regarding your specific state, your attorney general’s office will assist you further in the matter. But its always a great idea to understand your lease contract. If you are renting from a private landlord or a private house, you might even consult an attorney to make sure everything is in order.

The Fair Housing Act

There are many laws that vary from state to state, but the Fair Housing Act will include everyone. This will prohibit anyone from declining your rental application based upon a certain set of criteria. These include color, sec, handicap, race, familial status, etc. This will also prevent the landlord from evicting you based upon these criteria too. If you have a disability, you should know that the landlord cannot prevent you from making any changes to use the housing.

Local Laws

But you should be familiar with the laws in your state. Your landlord must be compliant with all local health codes and cannot simply evict you because he or she chooses to do so. They also cannot enter your domain unless there are emergency repairs to be conducted. If the apartment management company makes a huge mistake that affects you, be sure and get thorough documentation of the event that occurred. Then you will be in position to talk with your management company about any what happened and what they plan to do to rectify the situation.
